Fair Use Policy

Last updated: September 7, 2026

This Fair Use Policy ("Policy") explains what "unlimited calling and texting" means on KLEAR CRM, what usage falls outside it, and how we enforce this Policy. It is part of our Terms of Service and applies to every plan that includes unlimited calling or texting.

The short version: your people talk and text free; robots draw from a published monthly allowance. We will never silently throttle, degrade, or bill you for usage — if your usage ever becomes an issue, you will hear from us first.

1. What "Unlimited" Covers

Unlimited calling and texting covers normal business use by live individuals:

  • Phone calls dialed or answered by a person on your team
  • Text messages typed and sent by a person from the KLEAR inbox or mobile apps
  • Conversational, two-way messaging with your customers

There is no hidden minute or message cap on this usage. We do not throttle it, slow it down, or charge overage on it.

2. What "Unlimited" Does Not Cover

The following usage is not included in unlimited calling and texting:

  • Auto-dialers, predictive dialers, or robocalling of any kind
  • Operating a call center or telemarketing operation on seat plans
  • Bulk, broadcast, or automated messaging campaigns
  • Machine-initiated traffic: bots, scripts, or calls/messages originated through the API on a seat plan
  • Reselling, trunking, or otherwise redistributing the service
  • Continuous call forwarding or similar schemes designed to route third-party traffic through your account

3. Automated Messages and Your Monthly Allowance

Automation built into KLEAR — workflow messages, AI-agent replies, auto-replies, and messages sent through Zapier, webhooks, or the API — is a supported, first-class part of the product. It is simply metered separately from human use:

  • Each plan includes a published monthly allowance of automated messages (shown on the pricing page and inside your billing settings)
  • When your team reaches 90% of the allowance, account owners are notified in the app
  • When the allowance is used up, automated sends pause until your next billing period — with a notice to account owners. Paused workflow messages resume automatically when the new period starts
  • Prefer no interruption? Account owners can opt into pay-as-you-go overage: automation keeps running at a published rate of $0.02 per automated message beyond the allowance, capped at a monthly spend limit you control (default $250), billed on your next invoice. It is off by default and never turns on without an owner enabling it
  • Calling and texting by your team continue to work normally the entire time — only automation pauses

We never retroactively bill for automated messages already sent, and nothing pauses without a notice you can read in the app.

4. How We Enforce This Policy

We review usage patterns to keep the service reliable and fairly priced for everyone. If your account's usage appears to fall outside this Policy (for example, dialer-like calling patterns or machine-shaped traffic on a seat plan), here is exactly what happens:

  • Notice first. We will contact you, explain what we're seeing, and discuss the right plan for your usage. Nothing is throttled, degraded, or shut off silently.
  • An opportunity to migrate. If your usage needs a high-volume or custom plan, we will offer one with visible rates before anything changes.
  • Prospective only. Any required plan change takes effect going forward, with at least 30 days' notice. We never retroactively bill for past usage that was labeled unlimited.
  • Last resort. Only if usage remains out of policy after notice and a migration offer may we suspend the out-of-policy usage or the account, as described in our Terms of Service.

We apply this Policy consistently across all customers.

5. Messaging Compliance

Independent of volume, all messaging on KLEAR must comply with our Acceptable Use Policy and applicable law — including TCPA consent requirements, STOP/HELP opt-out handling (enforced platform-wide), and carrier registration requirements (toll-free verification and A2P 10DLC). Sending to people who have not consented is prohibited at any volume.

6. Changes to This Policy

We may update this Policy from time to time. Material changes will be communicated by email or through the Service, and the "Last updated" date above will change. Continued use after changes take effect constitutes acceptance.

7. Questions

Not sure whether your use case fits a seat plan? Ask us before you build it — we'll tell you straight and point you at the right plan.
